Selectmen's Meeting - February 7, 1995
Selectmen Attending: Judith Murdoch, Charles Flynn, Joseph
Frisoli, Chair, Peter Jones and Catherine Kuchinski, Clerk.
Also: Joe Nugent, Executive Secretary to Board of Selectmen and
Deborah Eliason, attorney with Kopelman & Paige.
I. Opening: Chair Frisoli called meeting to order at 7:05pm
requesting the warrant and bills be signed. Chair noted counsel
present this evening seeking direction on the Luiz lawsuit appeal
filed by the Town. Luiz was a bidder in 1990 for the Library
Senior Center construction.
II. Executive Session request: Motion 2/7/95.1: move to enter
into Executive Session under number 3 for strategy for litigation
in the Luiz construction suit appeal. Motion by Murdoch with
second by Flynn. ROLL CALL VOTE: Murdoch: Aye; Flynn: Aye;
Frisoli: Aye; Jones: Aye; Kuchinski: Aye. Motion carried 5-0. at
7:10pm Board left open session noting a vote may be possible but
would then be announced when Board reentered open session for
adjournment.
III. Return to Open Session. Members returned to open session
at 7:40pm. Frisoli announced that in Executive Session, the
Board of Selectmen, by vote, instructed Town Counsel to proceed
with mediation and if necessary to continue with appeal in Court.
Adjournment: Motion 2/7/95.2: move to adjourn. Motion by Flynn
with second by Kuchinski. Motion carried 5-0.
